Cancellation Policy Overview
At SK Development Group, we understand that circumstances can change, and you may need to cancel or postpone your construction or remodeling project. This Cancellation Policy outlines the procedures, timeframes, and any applicable fees associated with canceling or rescheduling a project with us.
Please note that this policy is designed to be fair to both parties while accounting for the significant planning, scheduling, and resource allocation that goes into each project we undertake.
Pre-Contract Cancellations
If you need to cancel during the planning phase, before signing a formal Project Contract:
- Design Consultations: Initial consultations can be canceled or rescheduled with 24 hours' notice at no charge. Cancellations with less than 24 hours' notice may result in a $100 rescheduling fee.
- Design Plans: If custom design plans have been started but not finalized, a cancellation fee based on the percentage of work completed will apply.
- Material Selections: If materials have been selected but not ordered, no cancellation fee will apply. If special-order materials have been ordered, you will be responsible for any non-refundable deposits or restocking fees.
Post-Contract Cancellations
Once a Project Contract has been signed, the following cancellation terms apply:
Client-Initiated Cancellations
- Within 3 Business Days of Signing: You may cancel within three business days of signing the Project Contract with no penalty (cooling-off period).
- Before Project Start Date:
- 30+ days before scheduled start: 25% of initial deposit
- 15-29 days before scheduled start: 50% of initial deposit
- 7-14 days before scheduled start: 75% of initial deposit
- Less than 7 days before scheduled start: 100% of initial deposit
- After Project Has Begun: If you cancel after work has commenced, you will be responsible for:
- Payment for all work completed to date
- Payment for all materials ordered or purchased
- Any reasonable demobilization costs
- A cancellation fee of 15% of the remaining contract value
Contractor-Initiated Cancellations
SK Development Group reserves the right to cancel a project under the following circumstances:
- Non-payment: Failure to make payments according to the payment schedule outlined in the Project Contract
- Unsafe Conditions: Discovery of conditions that make the project unsafe or infeasible
- Permit Denials: Inability to obtain necessary permits or approvals
- Material Changes: Significant changes to the project scope that cannot be mutually agreed upon
In the event of a contractor-initiated cancellation not due to client non-performance, we will refund all unused portions of payments made, less costs for work completed and materials ordered.
Project Rescheduling
We understand that circumstances may require rescheduling rather than cancellation. Our policy for rescheduling is as follows:
- First Rescheduling Request: Projects can be rescheduled once with at least 14 days' notice at no additional charge, subject to availability.
- Subsequent Rescheduling: Additional rescheduling requests may incur a fee of $250 to cover administrative costs and schedule adjustments.
- Short-Notice Rescheduling: Rescheduling with less than 14 days' notice may incur fees based on the timing:
- 7-13 days' notice: $250 fee
- Less than 7 days' notice: $500 fee
Please note that while we will make every effort to accommodate rescheduling requests, our ability to do so depends on our overall project schedule and resource availability. Significant delays may require reconsideration of project pricing if material or labor costs have increased in the interim.
Force Majeure
Neither party shall be liable for delays or cancellations due to circumstances beyond reasonable control, including but not limited to:
- Natural disasters or severe weather events
- Acts of government or changes in regulations
- Labor disputes or strikes
- Pandemics or public health emergencies
In such cases, both parties will work together to reschedule the project without additional fees when circumstances permit.
Cancellation Procedure
To cancel or reschedule a project, please follow these steps:
- Submit your request in writing to info@skdevelopmentgroup.com or by certified mail to our office address
- Include your name, project address, and contract number
- Clearly state whether you are canceling or requesting to reschedule
- Provide the reason for cancellation or rescheduling (optional but helpful)
We will acknowledge receipt of your request within 2 business days and process it according to the terms outlined in this policy.
Refunds
Any refunds due following cancellation will be processed within 30 days of finalizing the cancellation. Refunds will be issued using the same payment method as the original payment when possible. Please refer to our separate Refund Policy for more details on refund processing.
Changes to This Policy
SK Development Group reserves the right to modify this Cancellation Policy at any time. Changes will apply to new contracts going forward and will not affect existing agreements. The current version of this policy will always be available on our website.
